If you are visiting SupPlant Ltd.’s website(s) or making use of any of our app(s) (including mobile apps), blog(s), social media site(s) or otherwise interacting with SupPlant Ltd. including via e-mail, then this Privacy Policy will apply to you.  In this Privacy Policy, our website(s), app(s) (including mobile apps), blog(s), social media site(s) or other interactions including emails are collectively referred to as our “Media”, and this Privacy Policy applies to all of our Media and your interaction with us in our Media. 

It is our hope and commitment that you feel completely at ease and secure in your interactions with us, and that you will trust us to respect your privacy.  So, we at SupPlant Ltd. have created this Privacy Policy (sometimes referred to as this “Policy”) to advise you about our practices concerning the information we may collect when you visit or use our Media (including the efforts that we are making to protect your Personal Information, as such term is defined below).

BY ENTERING, CONNECTING TO, ACCESSING OR USING THE MEDIA, YOU ACKNOWLEDGE THAT YOU ARE OR HAVE HAD THE OPPORTUNITY TO BECOME AWARE OF AND AGREE (IN JURISDICTION WHERE SUCH CONSENT IS REQUIRED) TO THIS PRIVACY POLICY AND SUPPLANT’S PRACTICES DESCRIBED THEREIN, INCLUDING THE PROCESSING (INCLUDING COLLECTING, USING, DISCLOSING, RETAINING OR DISPOSING) OF YOUR INFORMATION UNDER THE TERMS OF THIS POLICY.

Who are we?

In this Policy, references to SupPlant, or to the “Company”, “we”, “ours” or “us” are to SupPlant Ltd. which is a registered company in the State of Israel, having its principal office at 1 Yitzchak Rabin Blvd., Afula 1812001, Israel, and its affiliates. Individuals wishing to contact us about data protection issues may do so by writing to us at the above address or by emailing us at [email protected]. At SupPlant Ltd., we understand that protecting the privacy of visitors to our Media is very important and that certain information that we request of you or that you provide may be sensitive. That’s why we have taken reasonable steps to treat your Personal Information in accordance with our high standards, and consistent with applicable local laws that regulate the storage, process, access and transfer of Personal and Non-Personal Information, as those terms are defined below.

Aside from Personal and Non-Personal Information, as those terms are defined below, you understand that because of making use of our technological services, SupPlant Ltd. may collect and make use of data from your plants and their environment. Your hereby agree that SupPlant Ltd. shall have free and unfettered access to and use of said data, and you hereby waive and relinquish any claims to such data, including under privacy laws, regulations or other applicable legal duties. SupPlant Ltd. will have no liability to you or any other person on your behalf arising from SupPlant Ltd.’s violation of any restriction on the processing or use of said data while performing any services or apps.  Such “plant” data is not within the scope of this Privacy Policy.

Which information may we collect?

We may collect two types of data and information from our users:

  1. Non-identifiable and anonymous information (Non-Personal Information”) – which is being gathered, consists of technical information and behavioral information that does not pertain to a specific individual. Non-Personal Information is any unconcealed information which does not enable identification of an individual user, and which is available to us while you are entering into and/or using our Media. You may access and browse the Media without disclosing personal information, although, like most websites and online services, we passively collect certain Non-Personal Information from your devices when you access and browse our Media, including: (i) technical information such as the type and version of your device and its operating system, the type of browser, screen resolution, device browser and keyboard language, Wi-Fi connectivity and the type and name of your device and/or browser, etc.; and (ii) behavioral information which may include your click-stream on the Media, the activities on the Media and additional information of a similar nature (collectively, “Technical and Behavioral Information”). We also use third-party service providers such as Google Analytics, Mixpanel and Smartlook to obtain detailed analytics on your behavior on the Media.

Please note that: (i) we or our third-party service providers will collect such Technical and Behavioral Information by using certain technologies such as cookies, as further detailed below; and (ii) in some cases, we also remove personal identifiers from data you provide to us and maintain it in aggregate form. We may combine this data with other information to produce anonymous, aggregated statistical information (e.g. number of visitors, originating domain name of the Internet Service Provider), helpful to us in improving our products and services.

  1. Personally identifiable information (Personal Information”) – which may identify an individual or may be of a private and/or sensitive nature.

Personal Information which is provided consciously and voluntarily:

  • Communications with the Company: Personal Information you provide us as part of any communications with the Company, by any means, including by contacting us via our Media (for example, as part of the “Contact Us” page on our website) or any other communications method such as by email or through our social network pages. Such Personal Information may include: your name, e-mail address, phone number and any other information which you may voluntarily provide us.
  • Our newsletter and other commercial materials: you may voluntarily provide us with your contact details in order to subscribe to our newsletter and to receive commercial materials from us. You can opt out of receiving the newsletter at any time by following the opt instructions that it contains.

Personal Information collected via technology:

  • Technical and Behavioral Information: to the extent that the Technical and Behavioral Information will be linked to or associated with a specific individual, then such information will be considered as Personal Information.
  • Identifiers: while using the Media we may collect certain unique identifiers, such as Internet Protocol (IP) address, your Unique Device Identifier (UDID).
  • Geolocation data: while using the Media we will access, collect, process, monitor and/or remotely store “geolocation data”, including through the collection of IP addresses and other similar information to determine your general location for analytics and security purposes.

Please note that we (i) may cross-reference your Personal Information with other Personal Information we may have about you. Any Non-Personal Information connected or linked to or associated with any Personal Information shall be deemed as Personal Information as long as such connection, linkage or association exists; (ii) use third-party tracking services and usage logs, to track and analyze data from users of the Media and for purposes of security and fraud prevention; and (iii) may also use cookies and other tracking technologies to gather information regarding your use of the Media and the information for which you searched and accessed.

How do we Collect Information?

There are a few main methods that we use in order to collect information:

  1. We collect information through your entry and use of the Media. In other words, when you are using the Media we are aware of it and may gather, collect and store the information relating to such usage. For example, we gather your Technical and Behavioral Information.
  1. We collect information which you decide to provide us voluntarily. For example, we collect Personal Information when you contact us via our e-mail address, when you communicate with us in any other way such as, by using the “Contact Us” page in the website, etc.
  1. We collect information from third parties. Such information may include mailing lists and other information available from public sources.
  1. We collect information from public sources. We may collect Personal Information relating to you from public sources (i.e., information available on websites associated with you or your company or on social network pages and public databases).

We may gather, collect and store such information either independently or through the help of our authorized third-party service providers as detailed below.

What are the Purposes of the Collection of Information?

We collect Non-Personal Information and Personal Information in order to operate the Media and provide our services.

  1. Non-Personal Information is collected in order to:
    • Use it for statistical and research purposes and for customization and improvement of our Media.
    • Improve the quality of the Media and services by enhancing the user’s experience.
    • Keep the Media safe and secured and for prevention of fraud.
  2. Personal Information is collected in order to:
    • Enable the provision of the services.
    • Respond to your inquiries, requests, comments and suggestions and provide support and technical assistance.
    • Send you by email, SMS, phone, through web-browser notification or through the post updates, notices, announcements, and additional information related to us including any updated information regarding our Media and services.
    • Allow us to contact you with proposals and tailored information regarding new products, events, offers, services, features, enhancements, special offers, upgrade opportunities, and events of interest etc.
    • Email tracking – we may use tracking technology within the email we may send you in order to improve interactions with you and to better understand whether our emails were opened and read, and such tracking may include capturing the time and date in which you opened our email messages and the type of device you use to open such emails.
    • To conduct online surveys to better understand your needs, and how we can modernize, innovate and improve our Media.
    • Conduct internal operations, including troubleshooting, data analysis, testing, research and statistical purposes.
    • Comply with our legal obligations and in order to be able to protect our rights and legitimate interests, including in order to improve our services.

 

The Company stores personal information of its customers on servers located in Israel and abroad as part of the Company’s engagement with cloud hosting service providers (i.e., Microsoft and AWS), which are global well-known service providers that implement the highest level of data security measures, and such data is transferred to such cloud service providers under their standard terms of service. We are in the process of updating the Company’s privacy policy to accurately reflect the Company’s PII processing practices.

In some cases, certain Personal Information is collected by third-party service providers or apps that are implemented in connection with our providing our own technological services. Such third-party service providers may include companies that process payments that you make to us by credit card or third party apps like WHATSAPP® through which we may communicate with you.  In such cases, you are advised to review their Privacy Policies and related warranties and disclaimers.

Cookies.

A cookie is a piece of information that is placed automatically on your computer’s hard drive when you access certain web sites. The cookie uniquely identifies your browser to the server. Cookies allow us to store information on the server to help make the Web experience better for you and to conduct site analysis and web site performance review. Most Web browsers are set up to accept cookies, although you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. Note, however, that some portions of our sites may not work properly if you refuse cookies.

Web Beacons.

On certain Web pages or e-mails, SupPlant Ltd. may utilize a common Internet technology called a “Web beacon” (also known as an “action tag” or “clear GIF technology”). Web beacons help analyze the effectiveness of web sites by measuring, for example, the number of visitors to a site or how many visitors clicked on key elements of a site.

Web beacons, cookies and other tracking technologies do not automatically obtain personally identifiable information about you. Only if you voluntarily submit personally identifiable information, such as by registering or sending e-mails, can these automatic tracking technologies be used to provide further information about your use of the web sites and/or interactive e-mails to improve their usefulness to you.

When you access or use our Media, we and/or our third party service providers may use industry-wide technologies such as cookies, web beacons, pixels, clear gifs and other similar tools (or other similar technologies) (collectively, “Cookies“) which may enable us, amongst others, to recognize your device from those of other users of our Media, to improve the Media’s performance, to deliver a better and more personalized service according to our users’ individual interests and the device or browser used, to track users’ use of the Media, to prevent fraud and/or abuse, to estimate our audience size and usage pattern and perform other analytics, to develop our Media and to serve targeted advertisement.

Cookies may locally store certain Technical and Behavioral information and other Personal Information on your device and we and/or our authorized third-party service providers may access such information for the purposes detailed under this Privacy Policy. We and/or our authorized third-party service providers may use both session Cookies (which expire once you close the web-browser) and persistent Cookies (which stay on the user’s device until he/she deletes them).

Most devices and browsers will allow you to erase Cookies from your device’s hard drive, block acceptance of Cookies, or receive a warning before a Cookie is stored on your device. However, if you block or erase Cookies, your experience of the Media may be limited.

Security

SupPlant Ltd. uses reasonable technology and security precautions, rules and other procedures to protect your Personal Information from unauthorized access, improper use, disclosure, loss or destruction. To ensure the confidentiality of your information, SupPlant Ltd. uses also industry standard firewalls and password protection. Your Personal Information is hosted on third parties’ servers, which provide advanced strict security standards (both physical and logical). It is, however, your personal responsibility to ensure that the computer or mobile device you are using is adequately secured and protected against malicious software, such as Trojans, computer viruses and worm programs. You are aware of the fact that without adequate security measures (e.g. secure web browser configuration, up-to-date antivirus software, personal firewall software, no usage of software from dubious sources) there is a risk that the data and passwords you use to protect access to your data, could be disclosed to unauthorized third parties. In addition, there are inherent risks in transmission of information over the Internet or other methods of electronic storage and we cannot guarantee that unauthorized access or use will never occur.

International Data Transfer

The information collected from you, as detailed in this Privacy Policy, is stored in Israel as well as on servers located in other jurisdictions outside of Israel, and may, in whole or in part, be transferred, and further transferred, to affiliated entities, any future and/or potential investor or acquirer of the Company (including an acquirer of all or a portion of the Company’s business or assets) or to other third party service provides (such as hosting cloud services as mentioned above), who may be located in countries outside of your jurisdiction, including in a country whose laws do not ensure the same level of protection as the level of protection under the privacy protection laws applicable in your jurisdiction. Any transfer of data will be in accordance with the safeguards permitted under applicable privacy laws and regulations.

Your rights

To exercise any rights you may have under applicable privacy laws (such as the right to access, the right to rectification and the right to delete) please contact us by sending an email to: [email protected], with sufficient details and we will respond within a reasonable timeframe, but in any event no later than as required by applicable law. We confirm that we do not sell your Personal Information.

Data Sharing and Transfer  

SupPlant Ltd. may share Personal Information about you with various outside companies or agents doing technological maintenance or working on our behalf to help fulfill business transactions, such as providing customer services, sending marketing communications about our products, services and offers. All these companies and agents are required to comply with the terms of our privacy policies and may include without limitation the following categories of service providers:

We respect your privacy and will not disclose, share, rent, or sell your Personal Information to any third party, other than as permitted under this Privacy Policy.

In addition to using the information collected by us for the purposes described under this Privacy Policy, we may also disclose Personal Information in the following cases:

  • Company’s Personnel: Personal Information that we collect and process may be transferred to or accessed by our personnel for the sole purpose of enabling the provision of our services and to contact you. Please note that all of the personnel that will have access to your Personal Information are under an obligation of strict confidentiality with respect to such Personal Information.
  • Service Providers: we may share Personal Information with third parties as mentioned above.
  • In addition, we may share Personal Information in the following cases: (i) to respond to appropriate requests of legitimate government agencies or where required by applicable laws, court orders, or government regulations; (ii) where needed for corporate audits or to investigate or respond to a complaint or security threat; (iii) to enforce this Policy or any other agreement or terms of service between you and us, and to defend against any claims or demands asserted against us by you or on your behalf; (iv) to detect, prevent, or otherwise address fraud, security or technical issues; (v) to protect the rights, property, or personal safety of SupPlant, its users or the general public; and (vi) when SupPlant is undergoing any change in control, including by means of merger, acquisition or purchase of all or substantially all of its assets (while such acquired company or investor may be located in countries outside of your jurisdiction).
  • For avoidance of doubt, SupPlant may transfer and disclose Non-Personal Information to third parties at its discretion including without limitation for statistical, analytical and research purposes and for customization, developing and improvement of our Media.

E-mail a Friend or Colleague.

On some SupPlant Ltd. Media, you can choose to send a link or a message to a friend or colleague referring them to a SupPlant Ltd. Media. E-mail addresses you may provide for a friend will be used to send your friend information on your behalf and will not be collected or used by SupPlant Ltd. or other third parties for additional purposes.

Links to Other Sites

Our sites contain links to a number of web sites and Social Media such as FB, G+, Twitter and more that may offer useful information to our visitors. These linked sites and services are not under the control of the Company and it is not responsible for the availability of such external sites or services, and does not endorse and is not responsible or liable for any content including but not limited to content advertising, products or other information on or available from such linked sites and services or any link contained in linked sites or service. In addition, the Company is not responsible or liable for such linked sites and services’ privacy practices and/or any other practices. Your access to, use of and reliance upon any such sites, services and content and your dealings with such third parties are at your sole risk and expense. The Company reserves the right to terminate any link at any time. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused, by or in connection with use of or reliance on any services, content, products or other materials available on or through such linked sites or resource. Most of such linked sites and services provide legal documents, including terms of use and privacy policy, governing the use thereof. It is always advisable to read such documents carefully before using those sites and services, inter alia, in order to know what kind of information they are collecting.

Privacy Policy for Children

Our Media are directed at an adult audience. We do not intend and does not knowingly collect any Personal Information from anyone under the age of 16 years of age without the prior, verifiable consent of his or her legal representative. Such legal representative has the right, upon request, to view the information provided by the child and/or to require that it be deleted. We reserve the right to request proof of age at any stage so that we can verify that minors under this age are not using the Media. If we learn that we collected Personal Information from minors under the age of 16 years of age we will delete that information as quickly as possible. Data Retention

Note that unless otherwise explicitly specified herein and/or unless you instruct us otherwise, we may retain your Personal Information for as long as reasonably required for the purposes of which such Personal Information was collected, all as permitted under any applicable privacy laws. Personal information which is no longer required for the purpose for which is was initially collected will be deleted unless we have a valid justification to retain it which is permitted under applicable law, such as to resolve disputes or comply with our legal obligations. Aggregated and/or anonymous information derived from your use of our Media may remain on our servers indefinitely.

Changes to the Privacy Policy

We may need to change this Policy from time to time to address new privacy or other matters and/or to reflect changes to our Media. We will post such changes in this Policy so that you are updated regarding what information we gather, how we may gather that information, how we may use that information and whether we will disclose that information to anyone.  It is advisable, therefore, to refer back to this Policy from time to time.
